Terms of Service

Last updated November 2, 2026

These terms are an agreement between you and Penna. Technology LLC, the company that makes Half Light ("Half Light", "we", "us" or "our"). They cover the Half Light apps for iPhone and Android, the web app at app.halflighthunting.com, this website and its share, invite and location pages, and everything we provide through them (together, the "Service").

By creating an account, signing in, or using the Service, you agree to these terms and to our Privacy Policy. If you don't agree, don't use the Service.

Please read sections 4 and 21 carefully. Section 4 explains that Half Light helps you plan, but it is not a legal boundary, a rule book or a safety device. You're responsible for hunting safely and legally, and maps, boundaries, legal light times, forecasts and live locations can be wrong. Section 21 says that most disputes will be settled by binding individual arbitration instead of in court, and that you give up the right to a jury trial and to take part in a class action. You can opt out of arbitration within 30 days (section 21.9).

1. Who can use Half Light

2. Your account

3. The Service, and changes to it

Half Light includes maps and map layers, weather, wind and scent, sun, moon and legal light times, hunt insights, scouting markers, a harvest journal, photos, trail camera photos by e-mail, offline map areas, sharing, groups and chat, live location sharing, and badges.

4. Hunting, safety and the law

Hunting is dangerous and closely regulated. Half Light is a tool to help you plan and record your hunts. It does not replace your own judgment, official regulations, a land survey, an official weather service, or safety equipment.

4.1 You're responsible for following the law

You alone are responsible for knowing and following every federal, state, tribal and local law and regulation that applies to you. That includes rules on licenses, tags, permits and hunter education; seasons, bag and possession limits; legal shooting hours; legal methods, weapons and ammunition; bait, feeders, minerals and food plots; tree stands, blinds and camping; trail cameras; drones; tagging, reporting and transporting game; and motor vehicle use.

Some states restrict using electronic devices, live location, real-time communication or trail camera images to find or take game, especially during the season or on public land. Check the rules where you hunt before using those features. Nothing in the Service is legal advice, and nothing in it means that an activity is legal.

4.2 Maps and land boundaries are approximate

Public land boundaries, managing agencies, access, roads, trails, motor vehicle use maps and closures come from government agencies and other third parties. They can be inaccurate, incomplete or out of date. Private land property lines are approximate and are not a survey, and owner names can be wrong or out of date.

A map showing land as public, or showing who owns land, is not permission to enter, cross or hunt it. It's your responsibility to confirm boundaries, access, closures and regulations with the land manager or landowner, to get any permission required, and not to trespass. Posting and trespass laws differ from state to state.

4.3 Legal light, sun and moon times are estimates

Legal shooting light, sunrise, sunset, moon and solunar times are calculated for your location with astronomical formulas. States set legal hours in different ways, sometimes with published tables or different rules for different species, and our times can be wrong. Always use the official times in your state's regulations.

4.4 Weather, wind and scent

Forecasts, radar, wind and scent cones come from the National Weather Service, NOAA, MET Norway and our own models. Real conditions can differ a lot from a forecast, especially in hills and timber, and a scent cone is a simplified estimate. Don't rely on the Service for decisions about weather safety. Check official forecasts and warnings, and watch the conditions yourself.

4.5 Hunt insights are predictions

Day ratings, movement outlooks, rut, gobbling and migration timing, best times to sit and the deer movement map are estimates based on research, weather and models. They're for information and enjoyment, they can be wrong, and they don't promise that you'll see or take game.

4.6 Not a navigation or safety device

GPS positions, distances, bearings and offline maps can be wrong or unavailable because of your device, battery, signal, settings, or errors in our software or data. Offline areas may not include every layer. Don't rely on the Service as your only way to navigate. Carry a backup map, a compass, a light and other safety gear, and tell someone where you're going and when you'll be back.

Half Light is not an emergency service. In an emergency, call 911.

4.7 Live location is not a safety tool

The positions you see may be minutes old or older, may be inaccurate, and may stop updating without warning, for example when a phone loses signal or battery, or when its settings or our servers stop it. A dot on the map doesn't mean a person is there, and no dot doesn't mean no one is there.

Never use the Service to decide whether it's safe to shoot. Before every shot, positively identify your target and know what's in front of it and beyond it. Wear blaze orange where the law requires it or where it's wise. Don't rely on live location to find a lost or injured person: call 911.

4.8 Using your phone in the field

Don't let the app distract you from your surroundings. Don't use it while driving or operating a vehicle, ATV or boat, while handling a firearm or bow, or while climbing into or out of a tree stand. Use a full-body harness in tree stands.

4.9 You accept the risks of hunting

Hunting and other outdoor activities carry risks that can't be removed, including serious injury or death from firearms, bows, falls (including from tree stands), weather, exposure, terrain, water, wildlife, vehicles and other people. You take part in these activities voluntarily, and you accept all of those risks. To the fullest extent the law allows, we're not responsible for your hunting or outdoor activities or anything that happens during them, including any decision you make based on the Service.

5. Plans, subscriptions and payment

5.1 Plans

Half Light has a free plan and paid plans (currently Basic and Pro). Each plan has features and limits, for example on markers, offline areas, photos, trail cameras, sharing, live location and groups. The plans page in the app lists each plan's main features. The free plan also has small allowances for sharing and photos, and the app tells you when you're about to reach one. Plan features and limits can change (section 3). A plan applies to your account on every device: the iPhone app, the Android app and the web.

5.2 Automatic renewal

Paid plans are sold as monthly or yearly subscriptions. YOUR SUBSCRIPTION RENEWS AUTOMATICALLY AT THE END OF EACH PERIOD, FOR A PERIOD OF THE SAME LENGTH, AT THE PRICE IN EFFECT AT THAT TIME, AND IS CHARGED TO YOUR APP STORE OR GOOGLE PLAY ACCOUNT, UNTIL YOU CANCEL. To avoid being charged for the next period, cancel at least 24 hours before the current period ends.

5.3 Free trials and introductory prices

If we offer a free trial, you'll be charged when it ends unless you cancel at least 24 hours before. Any unused part of a free trial ends when you buy a subscription. An introductory or launch price applies for the period shown when you subscribe; after that, the regular price applies unless we tell you otherwise. The store decides who's eligible for trials and introductory prices.

5.4 Billing and refunds

Apple or Google processes in-app purchases under their own terms. We never see your card details. Refunds for in-app purchases are handled by Apple or Google under their policies; we can't issue them. You're responsible for any taxes the store charges.

If we sell plans directly, for example on the web, we'll show the price, how renewal works and how to cancel before you pay, and the rest of this section applies the same way. Except where the law requires otherwise, those payments aren't refundable, including for part of a period.

5.5 Price changes

We may change subscription prices. The store will tell you in advance as its rules require, and may ask you to agree. If you don't want to pay the new price, cancel before it applies.

5.6 When a paid plan ends

When a paid plan ends, or you move to a smaller plan, we don't delete what you've saved because of it. The smaller plan's limits apply from then on. For example, you can't add markers, offline areas, photos, trail cameras or groups above its limits, "all harvests" and "all markers" shares stop picking up new items, and groups you own may stop taking new members. Unsaved trail camera photos expire on the schedule of the plan you're on (section 10).

6. Promo codes and free plans

7. Your content

7.1 You own your content

Your markers, harvests, notes, photos, trail camera photos, forecast spots, messages, group names and photos, and the name you show to others ("Your Content") belong to you.

7.2 The permission you give us

You give us a worldwide, non-exclusive, royalty-free license to host, store, copy, process, transmit, display and adapt Your Content, only as needed to provide, secure and improve the Service. Adapting includes, for example, resizing photos, making thumbnails and removing location data from photos. The license includes showing Your Content to the people, groups and link holders you share it with. It lasts while Your Content is on the Service, plus the time it takes to clear it from backups. For messages you post in groups, which stay in the group after you leave or delete your account (shown as from a deleted user), it lasts as long as the group does.

We may also create aggregated or de-identified information from use of the Service that doesn't identify you and doesn't reveal your spots, and use it to run, understand and improve the Service, for example to make hunt insights more accurate.

7.3 Your promises about Your Content

You confirm that you have the rights to Your Content and to give us the license above, and that Your Content and our use of it under these terms won't infringe anyone's rights or break any law. If Your Content shows other people, you're responsible for having any permission the law requires.

7.4 Keep your own copies

The Service syncs your data, but it isn't a backup service. Data saved on a device but not yet synced, for example while you're offline, can be lost if the app is deleted or the device is lost. Unsaved trail camera photos expire (section 10). Keep your own copies of anything important. To the fullest extent the law allows, we're not responsible for lost content.

7.5 We may remove content

We don't review content before it's posted and we don't have to monitor the Service. We may remove or refuse anything that we believe breaks these terms or the law, or could harm users, us or others. Content posted by other users is their responsibility, not ours.

7.6 Feedback

If you send us ideas or suggestions, we may use them freely, without owing you anything.

8. Sharing, groups, chat and live location

8.1 You control what you share

When you share a harvest, a marker or your location, the people, groups and link holders you choose can see it. A link to a single harvest works for anyone who has it until you stop sharing, and links can be forwarded. Exact locations are left out of shared harvests unless you turn them on. Once others have seen something, they may remember it, screenshot it or write it down; stopping a share removes it from the Service but can't undo that.

8.2 Respect what others share with you

What others share with you is for your own use. Don't pass on, publish or sell locations, spots or photos you were shown without the owner's permission.

8.3 Groups

The person who starts a group is its owner and is responsible for running it. Owners can invite people, remove members, take shared items out of the group, delete messages, hand the group over and delete it. Owners must follow these terms, and they don't act for us. How many people a group can hold depends on its owner's plan. If the owner's plan lapses, or the group has no owner, the group may stop taking new members and its details may be locked.

8.4 Community rules

Before your first group message, the app asks you to agree to our community rules. They're part of these terms. In short: no harassment, threats, hate or sexual content; nothing illegal, including poaching or trespassing; and respect people's spots by not passing on locations you were shown.

8.5 Reports, blocking and moderation

Anyone can report a message or a person, and block a person. Our staff review reports, including the reported content and the conversation around it. We may delete messages, remove shared items, remove people from groups, delete groups, and suspend or remove accounts. We don't promise to act on every report or within any particular time.

8.6 Live location

Live location runs only when you start it, only with the people or groups you choose, and only until the time you set or until you stop it. While it runs, your phone sends your position in the background, which uses battery and data, and your phone shows that it's running. The people you share with see your last position and how old it is. Never share someone else's location, and never use the Service to track a person without their knowledge and consent. Read section 4.7.

8.7 Dealing with other users

You're responsible for your dealings with other users, including meeting or hunting with them, and any agreement you make with them, such as a lease, a guided hunt or a sale. We don't check who users are and we're not part of those dealings.

9. Badges and trophy rooms

Badges, crowns, goals, Rookie of the Year and trophy rooms are for fun. They're based on what users log, and we don't verify harvests, scores, weights or any other claim. They aren't official records, and we're not affiliated with any record-keeping organization. They carry no prize and have no cash value. We may change, recalculate, take away or stop any badge or award, including where we believe a harvest was logged falsely or taken unlawfully. A badge never means that a harvest was legal.

10. Trail cameras

11. Rules of conduct

You agree not to do, or help anyone else do, any of the following:

  1. break any law, or use the Service to plan, commit, encourage or show off illegal activity, including poaching, hunting out of season or over the limit, trespassing, and illegal vehicle use;
  2. harass, threaten, stalk, bully, intimidate or hurt anyone, or post hate speech, sexual content, or anything that sexualizes or endangers minors;
  3. use the Service to find, follow, interfere with or harass hunters, landowners, or anyone else lawfully using land;
  4. track or share anyone's location without their knowledge and consent;
  5. use owner names or other landowner information for mailing lists, marketing, solicitation, debt collection, or unwanted contact, or to decide anyone's eligibility for credit, insurance, employment or housing;
  6. copy in bulk, scrape, crawl, extract or resell maps, tiles, parcel data, forecasts or other content of the Service, store it outside the app's offline feature, or use it to build a competing product or to train machine learning or AI models, without our written permission;
  7. access the Service by bots, scripts or other automated means, or through anything other than our apps and website (search engines may index our public pages as our robots.txt allows);
  8. get around plan limits, security or access controls, for example by opening extra accounts to get more free allowances, or by guessing codes or share links;
  9. reverse engineer, decompile or modify the apps, except where the law allows it despite this rule;
  10. overload or interfere with the Service, upload malware, or test it for weaknesses without our permission (if you find a security problem, please tell us at support@halflighthunting.com);
  11. impersonate anyone or misrepresent who you are or who you're with;
  12. post spam, chain messages, or advertising that a group didn't ask for;
  13. post content you don't have the rights to, or that infringes anyone's intellectual property, privacy or publicity rights, or post someone else's private information;
  14. log false harvests or otherwise manipulate badges, crowns or goals;
  15. sell, rent or transfer your account or plan; or
  16. use the Service in breach of U.S. export control or sanctions laws.

12. Third-party data and services

12.1 Data from others

Map, land, parcel, weather and other data come from third parties, including OpenStreetMap contributors, the U.S. Geological Survey, the U.S. Forest Service, NOAA and the National Weather Service, MET Norway, and state and county agencies. They're credited in the app under Account → Data & credits and at halflighthunting.com/private-land. They don't endorse Half Light. We provide their data as we receive it, and it can change or stop. Their license terms apply to their data, and nothing in these terms limits any right you have in public domain or openly licensed data that you get from its original source. Map data is © OpenStreetMap contributors and available under the Open Database License at openstreetmap.org/copyright.

12.2 Services we rely on

The Service depends on providers such as Apple, Google, Facebook, Supabase, Cloudflare, Firebase and RevenueCat. We're not responsible for their outages or actions. Your use of the App Store, Google Play, and your Google or Facebook account is governed by their terms.

12.3 Links

The Service links to other websites, such as state regulations and data licenses. We don't control them and aren't responsible for them.

13. Our rights in the Service

The Service, including its software, design, text, graphics, map styles, hunt insight models, badges, and the Half Light name and logo, belongs to us or our licensors and is protected by law. Apart from Your Content and third-party data, we keep all rights not expressly given to you.

Subject to these terms, we give you a personal, limited, non-exclusive, non-transferable, revocable license to install and use our apps and to use the Service for your own hunting and outdoor activities, including organizing your hunting group, club, lease or guided hunts. Don't use our name, logo or other trademarks without our written permission, except to refer to the Service accurately. Open source parts of the apps are licensed under their own licenses, which govern those parts.

We respond to notices of claimed copyright infringement under the Digital Millennium Copyright Act. If you believe content on the Service infringes your copyright, send our copyright agent a notice that includes:

  1. your physical or electronic signature;
  2. the copyrighted work you say is infringed;
  3. the material you say infringes it, and where it is on the Service (for example the share link, or the group and message);
  4. your name, address, phone number and e-mail address;
  5. a statement that you believe in good faith that the use isn't authorized by the copyright owner, its agent or the law; and
  6. a statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act for them.

Copyright agent: Copyright Agent, Penna. Technology LLC, 10311 Numers Hollow Road, Huntingdon, PA 16652; phone (814) 201-7554; support@halflighthunting.com with the subject "Copyright notice".

If we remove your content because of a notice and you believe it was a mistake, you can send our agent a counter-notice that includes your signature; the material removed and where it was; a statement under penalty of perjury that you believe in good faith it was removed by mistake or misidentification; your name, address and phone number; and a statement that you consent to the jurisdiction of the federal district court for your address and will accept service from the person who sent the notice. We may then restore the material in 10 to 14 business days unless that person tells us they've filed a lawsuit.

We end the accounts of repeat infringers in appropriate circumstances. Anyone who knowingly makes a false claim in a notice or counter-notice may be liable for damages. Send other intellectual property complaints to support@halflighthunting.com.

15. Privacy

Our Privacy Policy explains what we collect and how we use it. Information is processed in the United States. What you share is visible to others as described in section 8.

16. Ending your account

16.1 You can leave at any time

Delete your account in the app under Account → Delete account, or as described on our support page. Deletion is permanent. It deletes your account, markers, harvests, trail cameras, photos and shares. Messages you posted in groups stay, shown as from a deleted user. A group you own goes to a member you hand it over to, or carries on without an owner. Deleting your account doesn't cancel a store subscription and doesn't entitle you to a refund.

16.2 We can suspend or end your access

We may suspend your account (for example, stop you posting, sharing, joining groups or sharing your location), end your account or access, or remove content, if we reasonably believe that you've broken these terms or the law, that your account is being used fraudulently, or that your use creates risk or possible legal exposure for us or others, or if the law requires it. Where it's reasonable, we'll tell you why and give you a chance to fix the problem, unless that would create risk or break the law. If your account is ended for breaking these terms, you won't be refunded for any plan.

16.3 If we stop offering the Service

We may stop offering all or part of the Service. If we stop offering it entirely, we'll tell you in advance where we can, so you can cancel your subscription and ask for a copy of your data.

16.4 What continues

Sections 4.9, 6 (as to plans already ended), 7, 11 (for conduct before your account ended), 13 and 17 to 26 continue to apply after your account ends.

17. Disclaimers

THE SERVICE AND ALL CONTENT AND DATA IN IT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT THE LAW ALLOWS, WE AND OUR AFFILIATES, LICENSORS, DATA PROVIDERS AND SERVICE PROVIDERS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT AND QUIET ENJOYMENT, AND ANY WARRANTIES ARISING FROM A COURSE OF DEALING OR USAGE OF TRADE.

WE DON'T WARRANT THAT ANY MAP, BOUNDARY, PARCEL LINE, OWNER NAME, ROAD, TRAIL, CLOSURE, WEATHER FORECAST, WIND, SCENT CONE, LEGAL LIGHT TIME, POSITION, LIVE LOCATION OR HUNT INSIGHT IS ACCURATE, COMPLETE, CURRENT OR RELIABLE; THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR AVAILABLE OFFLINE OR IN ANY PARTICULAR PLACE; THAT DATA WON'T BE LOST; OR THAT DEFECTS WILL BE CORRECTED. NO ADVICE OR INFORMATION FROM US CREATES A WARRANTY NOT STATED IN THESE TERMS.

Some places don't allow implied warranties to be disclaimed. There, these disclaimers apply to the fullest extent the law allows.

18. Limitation of liability

TO THE FULLEST EXTENT THE LAW ALLOWS:

  1. NEITHER WE NOR OUR AFFILIATES, NOR OUR OR THEIR OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, LICENSORS, DATA PROVIDERS OR SERVICE PROVIDERS (THE "HALF LIGHT PARTIES") WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, HUNTING OPPORTUNITIES, LICENSES OR TAGS, FINES OR PENALTIES, OR THE COST OF SUBSTITUTE SERVICES, ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS, HOWEVER CAUSED AND UNDER ANY THEORY OF LIABILITY, EVEN IF WE WERE TOLD THEY WERE POSSIBLE.
  2. THE HALF LIGHT PARTIES WON'T BE LIABLE FOR ANY PERSONAL INJURY, DEATH, PROPERTY DAMAGE, TRESPASS, CITATION, FINE OR OTHER LOSS ARISING FROM HUNTING OR OTHER OUTDOOR ACTIVITIES, FROM ANYONE'S RELIANCE ON INFORMATION IN THE SERVICE, FROM THIRD-PARTY DATA, OR FROM THE CONDUCT OF ANY USER OR OTHER THIRD PARTY, ONLINE OR OFFLINE.
  3. THE HALF LIGHT PARTIES' TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WON'T EXCEED THE GREATER OF (i) WHAT YOU PAID FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT THAT GAVE RISE TO THE CLAIM, OR (ii) US $50.
  4. THESE LIMITS APPLY EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE. THEY'RE AN ESSENTIAL PART OF THE BARGAIN BETWEEN YOU AND US: WITHOUT THEM WE COULDN'T OFFER THE SERVICE FOR FREE OR AT ITS PRICE.

Nothing in these terms limits liability that the law doesn't allow to be limited, such as liability for our fraud, gross negligence or willful misconduct, or, where the law doesn't allow it to be limited, for death or personal injury caused by our negligence.

19. Indemnity

To the fullest extent the law allows, you will defend, indemnify and hold harmless the Half Light Parties from and against all claims, damages, losses, liabilities, costs and expenses, including reasonable attorneys' fees, arising out of or relating to: your use of the Service; Your Content; your hunting or outdoor activities, including trespass and injury to others; your breach of these terms or of any law; or your violation of anyone's rights. We may take control of the defense of any claim you must indemnify, at our own cost, and you'll cooperate with us. You won't settle such a claim without our written consent.

20. Disputes with other people

If you have a dispute with another user, a landowner or any other third party, you release the Half Light Parties from all claims, demands and damages of every kind, known and unknown, arising out of or connected with that dispute, to the fullest extent the law allows. If you're a California resident, you waive California Civil Code section 1542, which says: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party." You waive any similar law in other states too.

21. Arbitration and class action waiver

Please read this section carefully. It affects your legal rights, including your right to go to court.

21.1 Try to resolve it with us first

Before starting arbitration or a court case, the side with a claim must send the other a written notice describing it and the relief wanted. Send yours to support@halflighthunting.com with the subject "Legal notice", and by mail to Penna. Technology LLC, 10311 Numers Hollow Road, Huntingdon, PA 16652. Include your name, the e-mail address of your account, a description of the claim and what you want. We'll send ours to the e-mail address of your account. For 60 days after the notice arrives, we'll both try in good faith to resolve the claim, including by a phone or video call if either of us asks; if you're an individual, you'll take part personally (your lawyer can join). Time limits for bringing the claim are paused during those 60 days. Following this step is required before starting arbitration, and a court or arbitrator can enforce it.

21.2 Agreement to arbitrate

You and we agree that any dispute, claim or controversy arising out of or relating to these terms, the Service or our relationship, whether based on contract, tort, statute, fraud, misrepresentation or any other legal theory, and whether it arose before or after you agreed to these terms, will be resolved by binding individual arbitration, not in court, except as section 21.3 says. The arbitrator decides all questions about the scope, validity and enforceability of this section, except that a court decides questions about sections 21.6, 21.7 and 21.8. The Federal Arbitration Act governs this section.

21.3 Exceptions

21.4 How arbitration works

The American Arbitration Association ("AAA") will administer the arbitration under its Consumer Arbitration Rules (available at adr.org), as changed by this section. If the AAA can't or won't administer it, we'll agree on another provider, or a court will appoint one. A single arbitrator will decide. The hearing will be in the county where you live or by phone or video, and a claim of $25,000 or less may be decided on written submissions unless the arbitrator decides a hearing is needed. The arbitrator may award the same individual relief a court could, but only to the person bringing the claim and only as far as needed for that person's individual claim. The arbitrator will give a written decision, and a court with jurisdiction may enter judgment on it.

21.5 Costs

The AAA's rules decide who pays the filing, administration and arbitrator fees. If you show that the costs of arbitration would be prohibitive compared with going to court, we'll pay as much of them as the arbitrator finds necessary to prevent that. Each side pays its own attorneys' fees unless the law or the AAA's rules allow the arbitrator to award them. The arbitrator may award fees and costs against a side whose claim or defense was frivolous or brought for an improper purpose.

21.6 No class actions or jury trials

YOU AND WE MAY BRING CLAIMS AGAINST EACH OTHER ONLY AS INDIVIDUALS, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, CONSOLIDATED OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT COMBINE MORE THAN ONE PERSON'S CLAIMS OR PRESIDE OVER ANY CLASS OR REPRESENTATIVE PROCEEDING, EXCEPT AS SECTION 21.8 ALLOWS. YOU AND WE WAIVE ANY RIGHT TO A JURY TRIAL. If a court finds this paragraph unenforceable for a particular claim, that claim (and only that claim) will be severed and decided by a court under section 22, after any individual claims are arbitrated.

21.7 Public injunctive relief

If you ask for public injunctive relief (relief whose main purpose and effect is to prevent unlawful acts that threaten future injury to the public), and a court decides that you can't be required to arbitrate that request or waive it, the request will be severed and decided by a court under section 22, after the individual claims are arbitrated. The court case on it will be paused until then.

21.8 Mass filings

If 25 or more similar demands for arbitration are filed against us, or by us, by the same or coordinated lawyers, the AAA's Mass Arbitration Supplementary Rules apply. The lawyers on both sides will first choose 10 of the demands (5 each) to go forward to decision, while the rest wait and no fees are owed for them. After those 10 are decided, we'll mediate the rest in good faith. Any not resolved then will go forward in batches of up to 100, with one arbitrator for each batch. Time limits for bringing the waiting claims are paused meanwhile. A court can enforce this section.

21.9 You can opt out

You can opt out of this arbitration agreement within 30 days of first agreeing to these terms. E-mail support@halflighthunting.com with the subject "Arbitration opt-out", your name, the e-mail address of your account, and a clear statement that you're opting out. Opting out doesn't affect the rest of these terms. If you opted out of an earlier version, you remain opted out.

21.10 Changes to this section

If we change this section after you've agreed to it, you can reject the change by e-mailing us within 30 days of it taking effect, and the earlier version will keep applying to you. No change applies to a claim already noticed under section 21.1 or filed.

21.11 Survival

This section continues after your account ends. If any part of it other than section 21.6 is found unenforceable, the rest still applies.

22. Governing law, courts and time limits

The laws of the Commonwealth of Pennsylvania and applicable U.S. federal law govern these terms, without regard to conflict-of-law rules; the Federal Arbitration Act governs section 21. This doesn't take away any protection that the law of the state where you live says can't be waived by contract. The UN Convention on Contracts for the International Sale of Goods doesn't apply.

Any claim that isn't arbitrated will be brought only in the Court of Common Pleas of Huntingdon County, Pennsylvania, or the United States District Court for the Middle District of Pennsylvania, and you and we consent to those courts' jurisdiction, except that small claims may be brought wherever the small claims court allows.

To the fullest extent the law allows, a claim must be brought within one year after it arose, or it's permanently barred.

23. Apple and Google

23.1 If you got the app from Apple's App Store

  1. These terms are between you and us, not Apple. We, not Apple, are solely responsible for the app and its content.
  2. Your license to use the app is limited to Apple-branded products that you own or control, as permitted by the Usage Rules in Apple's Media Services Terms and Conditions, except that other accounts associated with yours through Family Sharing or volume purchasing may also use it.
  3. We, not Apple, are solely responsible for maintenance and support of the app. Apple has no obligation to provide any.
  4. If the app fails to conform to any warranty that hasn't been effectively disclaimed, you may notify Apple, and Apple will refund the purchase price of the app, if any. To the fullest extent the law allows, Apple has no other warranty obligation for the app. Any other claims, losses, liabilities, damages, costs or expenses due to a failure to conform to a warranty are our responsibility, to the extent they aren't disclaimed in these terms.
  5. We, not Apple, are responsible for addressing any claims by you or a third party relating to the app or your possession or use of it, including product liability claims, claims that the app fails to meet a legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
  6. If a third party claims that the app or your possession and use of it infringes their intellectual property rights, we, not Apple, are solely responsible for investigating, defending, settling and discharging that claim.
  7. You confirm that you're not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country, and that you're not on any U.S. Government list of prohibited or restricted parties.
  8. Questions, complaints or claims about the app go to us: Penna. Technology LLC, 10311 Numers Hollow Road, Huntingdon, PA 16652, support@halflighthunting.com.
  9. You must follow any third-party terms that apply when you use the app, such as your wireless data service agreement.
  10. Apple and its subsidiaries are third-party beneficiaries of these terms. Once you accept them, Apple has the right (and will be deemed to have accepted the right) to enforce them against you as a third-party beneficiary.

23.2 If you got the app from Google Play

Google's terms govern your use of Google Play. Google isn't a party to these terms and isn't responsible for the app.

24. Changes to these terms

We may update these terms. We'll change the date at the top, and if a change matters, we'll tell you in the app or by e-mail at least 30 days before it takes effect. Changes needed for legal reasons, or that only cover new features, can take effect sooner. If you keep using the Service after a change takes effect, you agree to the updated terms. If you don't agree, stop using the Service and delete your account. Changes don't apply to disputes already noticed under section 21.1 or filed.
